Terms and conditions

1. What we offer

DonkeyTalent is an online service. You provide a job offer and CVs in PDF format (up to 100 per report) and tell us what you are looking for. We analyze them and send you by email a report that ranks the candidates against the offer, with a score from 0 to 100 and a short summary of each one.

2. Who can buy

To buy you must be at least 18 years old. By buying you declare that you have the right to use the CVs you upload and that you comply with section 6.

3. Price and payment

Each report costs €10, taxes included. It is a one-time payment per report, with no subscription and no later charges. Payment is made in advance by card through Stripe, on its secure page. You always see the total amount before paying.

The contract is formed when you complete the payment. Stripe will send you a receipt by email if that option is enabled.

4. Delivery of the report

We send the report by email to the address you give us, as soon as it is ready. The time depends on the number of CVs, so we cannot guarantee an exact deadline. If you do not receive the report, write to us at info@donkeytalent.com and we will resend it or refund you.

Please check that your email address is correct: if it is misspelled, the report will go to another address.

5. Nature of the report

The report is an aid, not a decision. It is produced by automated systems, including artificial intelligence, which can make mistakes or misread a CV. The score is indicative and does not guarantee that any candidate is suitable.

The selection and hiring decision is always yours. We recommend reviewing the CVs of the candidates you are interested in and not basing any decision solely on the score.

6. Your obligations

• Upload only the CVs and data you need for the selection process.
• Have a legitimate reason to process the candidates' data and have informed them where the law requires it.
• Not use the service to discriminate against people on grounds prohibited by law.
• Not upload unlawful or harmful files, or files that are not CVs.

You are responsible for the data you upload and for how you use the report.

7. Personal data

We process your data and the candidates' data as explained in the privacy policy. For the candidates' data, you are the controller and we are the processor. The privacy policy and this clause form the data processing agreement.

8. Right of withdrawal

If you buy as a consumer, you have the right to withdraw from the contract within 14 calendar days of its formation, without giving any reason. To do so, write to us at info@donkeytalent.com stating that you withdraw.

By paying, you expressly ask us to start providing the service immediately and you acknowledge that, once we have delivered the report, the service will be fully performed and you will lose the right of withdrawal.

If you withdraw before delivery, we will refund the amount by the same payment method within 14 days at most. If we had already started providing the service, we will deduct the proportional part of what has been done.

9. Refunds

If we cannot deliver the report for a reason that depends on us, we will refund the full amount.

10. Intellectual property

You may freely use the report you receive for your own selection process. The software, design and other elements of the service remain DonkeyTalent's. The CVs remain their owners'.

11. Liability

DonkeyTalent is not responsible for the selection or hiring decisions taken on the basis of the report. Our liability to you is limited to the amount you paid for the affected report, to the extent the law allows. This limitation does not affect the rights the law grants to consumers or any liability that cannot be excluded.

12. Changes to the terms

We may change these terms or the price. Changes apply to contracts formed after they are published. Contracts already formed remain subject to the terms in force when you bought.

13. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts that have jurisdiction under the law; when you buy as a consumer, those of your place of residence.
